Fox Broadcasting has sent out a C&D order to Quicksilverscreen.com asking in a not-so-polite way that they stop linking to Fox-produced television shows that have been uploaded illegaly to sites like GooTube. For those of you who think this sounds familiar, you are right. The MPAA has tried this in the past and has won. Back then it was against 2600.com and their linking to copies of the DeCSS code. The judge ruled that if the linking is done with the intent to promote violation of copyright then it is indeed illegal.

I do not believe that this will be any different. The files were not legally uploaded to the sharing services by the content owners and are thusly being distributed illegaly, whether we like it or not. That's just the way the current laws read. IANAL, however.
